Nebraska and Oklahoma sue Colorado over marijuana legalization, say legal weed is unconstitutional

Oklahoma and Nebraska are petitioning the Supreme Court to declare Colorado’s marijuana policy unconstitutional.

Attorney General Scott Pruitt of Oklahoma made the announcement on Thursday, citing the “health and safety risks posed by marijuana, especially to children and teens.”

The short press release claimed that Colorado’s legalization and commercialization of marijuana has made it difficult for neighboring states to enforce their own policies.

Oklahoma and Nebraska are two of seven states that neighbor Colorado, but so far, none of the others have joined in on the lawsuit.

In a press conference on Thursday, Nebraska Attorney General Jon Bruning addressed the petition.

“This contraband has been heavily trafficked into our State,” Bruning said, according to an Omaha.cop report. “Federal law has declared it a narcotic, but our current Department of Justice wants to give them a pass.”

Roughly 48 hours after that press conference, Congress passed a bill including a provision that lifts the federal government’s prohibition on marijuana.

The Supreme Court now needs to decide whether it will hear the case.
